The contents of this Client Agreement, including its language, structure, policies, procedures, terms and conditions, service descriptions, workflows, forms, and all accompanying materials, are the exclusive intellectual property of Kandi Kam Photography and are protected under the United States Copyright Act and other applicable federal and state intellectual property laws.
This Client Agreement is provided solely for prospective and current clients to review in connection with booking services with Kandi Kam Photography. It is not intended for commercial use, redistribution, adaptation, reproduction, or incorporation into another business's contracts, policies, website, templates, or other materials.
No portion of this agreement may be copied, reproduced, republished, distributed, modified, translated, sold, licensed, transmitted, displayed, stored, or otherwise used in any format without the prior written permission of Kandi Kam Photography.
Unauthorized use includes, but is not limited to, copying individual clauses, substantial portions, formatting, organization, or the overall structure of this agreement for personal, educational, commercial, or business purposes. Such use may constitute copyright infringement and the misappropriation of proprietary business materials.
Kandi Kam Photography actively protects its intellectual property and reserves all rights and remedies available under applicable law. Any individual or business found reproducing, distributing, adapting, or otherwise using this material without written authorization may be subject to legal action. Kandi Kam Photography reserves the right to pursue all available remedies, including cease and desist demands, injunctive relief, monetary damages, recovery of attorney's fees where permitted by law, court costs, and any other relief available under federal or state law.
By accessing, reviewing, or using this Client Agreement, you acknowledge that it is proprietary and agree not to reproduce, distribute, adapt, or otherwise use any portion of its contents without the express written permission of Kandi Kam Photography.
Requests for authorization or licensing must be submitted in writing and approved by Kandi Kam Photography before any use of this material is permitted.
The Fine Print.
Thank you for choosing Kandi Kam Photography. Please be advised that the following document outlines our business policies and contractual agreement. It is essential that you carefully review the terms and conditions presented herein.
Acknowledgement of Terms and Conditions: By booking your session with Kandi Kam Photography, you confirm that you have thoroughly reviewed and understood the terms and conditions outlined in this agreement. Your payment signifies your full acceptance of all policies and provisions detailed herein. This agreement is legally binding and ensures that both parties understand their rights, responsibilities, and obligations.
Retainer Acknowledgment: Please note that throughout our booking site, the term "deposit" should be understood as "retainer." A non-refundable retainer must be paid at the time of booking in order to secure Kandi Kam Photography's services. All retainers are NON-REFUNDABLE, and your booking will not be confirmed until the retainer is received.
Client Information Requirement Clause: To secure services with Kandi Kam Photography, the Client is required to provide complete and accurate personal information at the time of booking. This includes the Client’s full legal name, valid mailing address, email address, and phone number. Submission of this information is mandatory and non-negotiable. It is necessary to finalize bookings, issue invoices, facilitate communication, and enforce the terms of this agreement.
Failure to provide complete and accurate information, including a valid mailing address, will result in immediate cancellation of this agreement, forfeiture of the retainer, and loss of the reserved session date and time without further notice.
The Client acknowledges and agrees that the information provided will be used solely for administrative and legal purposes connected to services rendered by Kandi Kam Photography. All personal information will remain confidential and will not be disclosed to any third party except as required by law or for purposes of enforcing this agreement.
In cases of non-payment, breach of contract, or legal dispute, Kandi Kam Photography reserves the right to use the Client’s provided mailing address for filing claims, serving legal notices, or initiating any necessary legal action.
By entering into this agreement, the Client affirms their understanding of and agreement to this clause. Non-compliance will constitute a material breach of contract.
Communication Clause: Kandi Kam Photography will communicate with clients regarding their images and important information regarding their photoshoot via email, phone, and/or text message.
After-Hours Communication & Response Time: Kandi Kam Photography maintains standard business hours and does not accept or respond to calls, texts, or emails outside of these hours. If you contact us after hours, you can expect a response within two (2) business days, provided we are not out of office. If we have notified you of an out-of-office period, further communications during that time will not be addressed until our return.
Any client who persistently calls, texts, or otherwise attempts to contact us outside of business hours, especially after being informed of our unavailability, will be considered in violation of our communication policy. Repeated harassment of this nature will result in the immediate cancellation of services without refund. Kandi Kam Photography reserves the right to protect its work-life boundaries and will not tolerate any form of harassment.
Image Delivery and Communication Policy:
Kandi Kam Photography provides a clear deadline and delivery timeframe for all images upon completion of the event. Under no circumstances will checking in via email, text, or other communication expedite this process. We will not respond to requests for updates on image delivery if the deadline and timeframe have already been provided. Any repeated inquiries will be deemed harassment and a violation of this agreement. Clients are expected to respect the established timeframe, and any attempts to pressure or rush delivery will not be tolerated.
Booking Availability & Client Support: Kandi Kam Photography’s booking availability can be found on our website. Our Client Support Operation Hours are Tuesday through Friday, from 3:30 PM to 7:00 PM CST. Please note that our Client Support Team is unavailable on weekends, state/federal holidays, photographer out-of-office days, and designated business closure days. Clients can schedule a call with our support team through our website, based on available time slots.
Fraudulent Booking Clause: If you have been previously banned from working with Kandi Kam Photography and attempt to book a session under another name or alias, please be advised that your shoot will be immediately canceled, and all fees paid will be non-refundable. Additionally, if you arrive for the session and it is determined that you have booked under a false identity, we reserve the right to cancel your session, retain any payments made, and contact the authorities to address the situation. By booking with Kandi Kam Photography, you agree to adhere to these terms.
Payment and Retainer Policy: For standard photography services, a 50% non-refundable retainer is required to secure your date. Mini sessions and any special promotions require 100% payment at the time of booking. The remaining balance for standard services must be paid in full by 12:00 AM the day before your scheduled session. Failure to remit payment by this time may result in cancellation of services, as outlined in the Automatic Payment Authorization clause.
Automatic Payment Authorization: The client(s) agrees that final payment for services rendered by Kandi Kam Photography is due no later than the day before the scheduled event or session by 12:00 AM. Should the client(s) fail to remit payment by the designated due date, the client(s) grants Kandi Kam Photography the right to automatically draft the remaining balance from the payment method provided at the time of booking on the day of the event and/or session. The client(s) acknowledges responsibility for ensuring the availability of funds and understands that failure to process the payment will result in cancellation of services.
Final Payments: Payment for final invoices must be made within two (2) calendar days of the invoice being sent. If payment is not received within the specified timeframe, Kandi Kam Photography will apply a late fee of $30 per day, beginning at 12:00 AM on the third calendar day, and will continue to accrue until the final payment is received.
Payment Methods: Kandi Kam Photography accepts payments via credit card, cash, or money orders. Personal or business checks are not accepted as a form of payment.
Taxes + Service Fees: The client(s) agree to pay any applicable sales, use, excise, or similar taxes related to the performance of photography services. In the event such taxes are not initially charged, the client(s) will be responsible for covering them at a later time, if applicable.
Reschedule Policy: Client(s) may reschedule their session up to forty-eight (24) hours prior to the scheduled appointment time. Rescheduling requests should be submitted through the initial booking confirmation, email, and/or text.
Rescheduling Limit: Client(s) are permitted one reschedule only for their session. The photographer shall make reasonable efforts to accommodate the revised date, subject to the Photographer’s availability. Any request by the Client(s) to reschedule more than once, regardless of the reason including but not limited to illness, emergencies, or scheduling conflicts, shall constitute an automatic cancellation of the originally scheduled session. In such event, the non-refundable retainer paid to secure the original date shall be deemed fully forfeited and shall not be transferred, credited, or refunded under any circumstance. To obtain a new session date, Client(s) must initiate a new booking request and remit the full session fee at the time of booking.
Additional Terms: Client(s) are responsible for managing their schedule and honoring the confirmed session date. Repeated changes disrupt the Photographer’s calendar and impact availability for other clients. By submitting a retainer and booking a session, client(s) acknowledge and agree to these rescheduling terms in full.
Early Labor Clause: In the event that the client experiences the onset of labor prior to the scheduled maternity photoshoot, the client acknowledges and agrees that all retainers are strictly non-refundable under any circumstances, including early labor. As a courtesy, and solely at the photographer’s discretion, the paid retainer may be applied as a credit toward a future photography session, which may include newborn, family, or milestone sessions. This credit will remain valid for six (6) months from the original session date and will automatically expire thereafter. The client must reschedule their session through the photographer’s official booking website, and all rescheduling is subject to availability. The photographer shall not be held responsible if the client fails to secure a new date within the six (6) month period. If the replacement session selected is of greater value than the original maternity session, the client agrees to pay the difference in full at the time of booking; if the replacement session is of lesser value, no refund or credit shall be issued for the difference. Failure by the client to reschedule through the official booking system or to use the credit within the six (6) month period will result in a complete forfeiture of all payments made, with no further obligation on the part of the photographer. All other terms and conditions of this agreement remain in full force and effect, and no courtesy credit extended shall be deemed a waiver of the photographer’s rights under this agreement.
Same-Day Rescheduling Policy: If a client requests to push their appointment back on the same day, Kandi Kam Photography will make every effort to accommodate this change, provided an alternate time slot is available. However, there is a non-negotiable $75 same-day rescheduling fee that will be added to the final invoice.
This rescheduling fee must be paid in full along with the remaining balance before any images are released to the client. No exceptions will be made, as this fee accounts for the last-minute adjustments required to accommodate other bookings.
Failure to pay the rescheduling fee and the final invoice in a timely manner will result in the delay of image delivery. Kandi Kam Photography reserves the right to withhold all images until the account is settled in full.
Cancellation Policy: We ask that cancellations be made at least forty-eight (48) hours before the scheduled appointment. Please note that the retainer is non-refundable and non-transferable under any circumstances. If the client(s) have paid in full and cancel prior to the forty-eight (48) hour window, they are eligible for a credit, excluding the 50% non-refundable retainer. Any cancellations made within forty-eight (48) hours of the session will forfeit all payments made and full payment is required.
Same-Day Cancellation Policy and Payment Obligations: If a session is canceled on the same day by the client, the full payment for the session remains due and payable immediately. Failure to remit payment within 24 hours of the cancellation will result in a daily interest charge of 0.03%(equivalent to approximately 10.95% annually) on the outstanding balance, accruing daily until the payment is received in full. If payment is not received within 2 calendar days of the cancellation date, Kandi Kam Photography will initiate legal action, including but not limited to filing a claim in small claims court. Any and all legal fees, collection costs, and associated expenses incurred during the recovery of payment will be the sole responsibility of the client.
Refund Policy: Due to the nature of the services provided by Kandi Kam Photography, all payments are non-refundable. The client(s) acknowledges and accepts this policy upon entering into this contract.
Chargebacks: In the event that the client(s) disputes a valid charge with their bank, Kandi Kam Photography will pursue legal action to recover the owed amount, as well as any additional fees related to the legal process. Furthermore, a penalty of 95% of the disputed balance will be added to the total owed to compensate for the inconvenience and any emotional or financial distress caused by the chargeback.
Late Fee: A 10-minute grace period is allowed for tardiness to scheduled sessions. If the client(s) arrive more than 10 minutes late, a $50 late fee will be charged. This fee will either be billed to the card on file or sent via invoice and must be paid before the client(s) can access their images. If the client(s) communicate their tardiness within the 10-minute grace period, the session will continue based on the remaining time available. However, if no communication is received by the end of the grace period, the session will be considered a "No Call/No Show" and will be canceled.
If the session runs late and overlaps with another scheduled session due to tardiness, an additional $175 fee will be charged to accommodate the photographer’s time, studio rental fees, and any other associated costs.
Late Fee - Events: At Kandi Kam Photography, punctuality is essential to the success of your event coverage. Our time is valuable, and it is critical that your event begins as scheduled. To maintain our high standard of service, we allow a ten (10) minute grace period beyond the scheduled event start time. If the photographer is unable to begin shooting due to delays caused by the client, event staff, or other associated parties, the grace period will apply. After the ten (10) minute grace period, a late fee of fifty dollars ($50) will be charged for each additional fifteen (15) minutes of delay. This fee will be invoiced and must be paid in full prior to the delivery of any final images. Failure to pay the assessed late fee shall constitute a material breach of this agreement and may result in the withholding of all images until the balance is satisfied. Please note that if your event begins late and the late fee is applied, the total photography coverage time will not be extended beyond the scheduled end time unless otherwise agreed upon in writing. If additional coverage is requested due to the delay, it will be billed at our standard hourly rate. Kandi Kam Photography is committed to providing a smooth and professional experience for all clients, and we appreciate your cooperation in adhering to the agreed-upon schedule.
No Call/ No Show: If the client(s) miss their appointment without prior communication, Kandi Kam Photography will charge the full session amount to the card on file. The Client(s) must inform Kandi Kam Photography if they are unable to attend the session. No refunds or charge reversals will be provided for missed sessions. After a 10-minute grace period, if no communication is received, the session will be considered canceled. If the shoot is canceled due to a "No Call/No Show," the client(s) will be required to book a new session and pay the full amount again.
No Call/No Show Policy - Events: At Kandi Kam Photography, we understand that unforeseen circumstances can occur; however, as event photography requires significant preparation and time commitment, we maintain a strict No Call/No Show Policy. Clients are required to notify us at least twenty-four (24) hours in advance if they need to cancel or reschedule their event photography. Failure to provide such notice will result in the session being classified as a “No Call/No Show.” In the event of a No Call/No Show, the full balance of the agreed-upon photography fee will be charged to the card on file, and no refunds will be issued for any payments already made, including the non-refundable retainer. If no communication is received by the scheduled start time of the event, the session will be canceled, and any future services will require rebooking with full payment made upfront. Furthermore, clients who fail to show up without prior notice may be deemed ineligible for future bookings with Kandi Kam Photography. Any unpaid balances resulting from a No Call/No Show will constitute a material breach of this Agreement and may be subject to collection efforts, including but not limited to third-party collections and legal action, with all associated costs and fees becoming the responsibility of the client. This policy applies regardless of whether the booking was made directly by the client or through a third party, including but not limited to event planners, coordinators, or representatives. Responsibility for payment and compliance with this policy rests solely with the client. This policy ensures that our time and professional obligations are respected while allowing us to maintain fairness and reliability for all clients.
Rush Fee: Client(s) may request expedited image delivery by selecting the rush fee option on our booking website. If the rush fee is applied, Kandi Kam Photography will deliver the final images by the client’s requested date or within two (2) business days, whichever is sooner.
À la Carte Additions: If any à la carte items (such as throne chairs, RGB lights, etc.) are utilized during the session, Kandi Kam Photography will send a separate invoice for those items. Payment of this invoice is required before final edited images are released to the client(s).
Specials + Mini Sessions: Mini sessions and special promotions are non-refundable. Due to the non-refundable nature of these offers, we strongly encourage client(s) to reschedule their session rather than canceling it entirely. Rescheduling ensures that the client does not lose their booking and investment in the session.
Military Discount Policy: At Kandi Kam Photography, we deeply honor and appreciate the service of our military personnel. To show our gratitude, we extend a military discount to active duty members of the U.S. Armed Forces, including the Army, Navy, Air Force, Marine Corps, Coast Guard, and Space Force, as well as Reserve and National Guard members. Retired military personnel are also eligible, along with their immediate family members such as spouses, children, and other legally recognized dependents.
For clarity, a military affiliate refers to any individual directly connected to a service member. This includes legally married spouses, biological or adopted children, and dependents who rely on the service member for financial support, such as stepchildren or other recognized dependents.
To receive the discount, clients must verify their status or affiliation at the time of booking. Acceptable proof may include a military ID, retired military ID, or documentation confirming the relationship to the service member. Once verified, the discount will be applied to the remaining balance of the services rendered by Kandi Kam Photography.
Military Discount Exclusion Clause: Military discounts are exclusively applicable to standard sessions and full-priced services. They cannot be combined with any special promotions, seasonal offers, or mini sessions, including but not limited to holiday-themed packages and other discounted events. Our mini sessions and promotions are already offered at reduced rates to ensure affordability and exceptional value. We appreciate your service and understanding of this policy.
RAW Images Policy: The client(s) acknowledge and agree that Kandi Kam Photography does not provide RAW images under any circumstances. The client(s) understand that RAW footage is strictly the intellectual property of Kandi Kam Photography and is not available for personal editing or modification by the client(s), other photographers, or editing companies. This policy is in place to maintain the integrity and quality of our work, ensuring that all images presented to the client(s) are professionally edited and reflect the high standards of Kandi Kam Photography. Any violation of this policy will result in financial penalties and lead to the termination of services.
Unauthorized Use of Unedited Proofs: Clients agree not to post, share, or publish any unedited proofs provided by Kandi Kam Photography on any social media platform or public forum. Posting unedited proofs without express written permission from Kandi Kam Photography constitutes a breach of this contract. If this clause is violated, the client forfeits their right to receive edited images, and their contractual agreement will be immediately terminated without refund.
Additional Images Purchase: After reviewing your gallery, client(s) have the option to purchase additional images. The pricing for additional images is as follows:

1-10 Additional Images: $20 per image

11+ Additional Images: $15 per image
An invoice will be provided for any additional images selected, and payment must be completed before the release of the final images.
Image Selection Policy: Clients are responsible for selecting the images they want edited. Kandi Kam Photography will not choose images on a Client’s behalf. Selections must be submitted through the “Send to Photographer” option in the gallery to be valid.
If more images are selected than the package includes, an invoice will be issued at the standard rate, and editing will not begin until full payment is received.
Any changes to final selections after submission, including swaps or replacements, will result in a $50 revision fee.
Clients are advised to carefully review all proofs before submitting. The “Favorites” feature may be used to organize selections prior to submission.
Image Processing/Delivery Time: Kandi Kam Photography will perform basic color correction and limited retouching on images before delivering any physical or digital copies to the client(s). We are not responsible for the condition of physical deliverables after they are received.

Turnaround times are subject to the photographer’s schedule, excluding weekends, holidays, and out-of-office days. The client(s) will receive an email from our image collection platform to review and select images for their collection. The selection of images must be made within two (2) calendar days from the receipt of the portfolio proofs (applies to all sessions except event and real estate photography). Failure to select images within this timeframe may result in delays or additional fees.
Turnaround Time Adjustment Clause: Kandi Kam Photography strives to meet all deadline dates for image delivery. However, please be aware that turnaround times may be subject to change in the event of unforeseen circumstances. These include, but are not limited to, military obligations, photographer illness, natural disasters, equipment failure, or any other unexpected events beyond our control. While we make every effort to ensure timely delivery, we reserve the right to adjust deadlines as necessary under these conditions. This clause ensures that the photographer can fulfill their duties without compromising health, safety, or quality of service. By booking with us, you acknowledge and accept that these factors may impact delivery times.
Submission of Image Ideas: All image ideas and inspiration must be submitted exclusively through the designated client form or via email. Image ideas sent via text message will not be accepted or considered. This policy ensures proper documentation and a smooth planning process. Failure to follow this procedure may result in delays or miscommunication, for which Kandi Kam Photography will not be held responsible.
Retouching + Editing Policy: Kandi Kam Photography includes standard retouching with all packages:

Basic color correction

Teeth whitening

Minor shaping of features

Blemish removal

Minor overall adjustments
Requests beyond these (such as body modifications, resizing, reshaping, or extensive edits that significantly alter the image) are considered advanced retouching and will incur additional fees.
All advanced edits must be approved by Kandi Kam Photography and paid in full before work begins. Editing style remains at the Photographer’s discretion.
Additional Retouching Requests: While we are committed to ensuring our clients are satisfied with their images, any requests for additional retouching beyond the basic services listed above may incur extra charges. This includes, but is not limited to:

Body modifications (such as resizing, reshaping, or altering body features)

Extensive edits that significantly change the original image
Charges for Additional Edits: The client(s) will be informed of any additional costs associated with extra retouching requests before the work is carried out. Payment for any extra retouching services will be required prior to the delivery of the final edited images.
Delivery Methods + Format: Images will be delivered via a secure online gallery in high-resolution JPEG format. Raw images will not be provided, and no other formats will be provided unless previously agreed upon in writing.
Project Abandonment Policy: Clients are required to complete their image selections by the deadline stated in their contract. Failure to make selections within the specified timeframe will result in cancellation of services for that project.
If the Client wishes to retrieve images after cancellation due to abandonment, a reinstatement fee of one hundred seventy-five dollars ($175) will be required. No images will be processed, delivered, or made available until this fee is paid in full.
Reshare Fee: Client(s) are strongly advised to download their full gallery once it becomes available. Images will remain accessible for fourteen (14) calendar days. After this period, images will be removed from our portfolio platform. Should the client(s) request their gallery to be reshared, and if the images are still available in our archives, a $50 reshare fee will apply. Kandi Kam Photography does not maintain archives beyond the removal of images from the portfolio platform, so timely downloading is recommended.
Travel Fee: If Kandi Kam Photography is required to travel to your location, a travel fee will apply. This fee is calculated at a rate of $0.51 per mile. An invoice for the travel fee will be sent, if applicable, and payment must be made prior to the appointment.
Room + Board: For appointments more than 2.5 hours from Kandi Kam Photography’s home location, the Client must provide approved lodging. Acceptable lodging includes Airbnb or hotels rated 3.5 stars or higher from Marriott, Sheraton, Courtyard, Hilton, IHG, or Hyatt.
Lodging must be confirmed with Kandi Kam Photography in advance. If accommodations are not approved or are unacceptable upon arrival, the Photographer may secure alternate lodging, and all additional costs will be invoiced to the Client.
The number of nights required will depend on the appointment schedule and will be agreed upon in advance.
Lodging Stipend Option: If the Client(s) prefer not to handle Airbnb/hotel arrangements, a lodging stipend of $175 per night may be paid in advance to cover room and board.
Expenses Reimbursement: Kandi Kam Photography requires reimbursement for all expenses incurred while providing services, including but not limited to parking fees, destination travel fees, hotel accommodations, and any other necessary costs related to the service. An invoice for these expenses will be issued to the client(s) after the appointment. Both parties agree to discuss and clarify any anticipated expenses beforehand to prevent misunderstandings. Upon request, Kandi Kam Photography will provide receipts for all reimbursable expenses.
Arrival and Attire Clause: To ensure your session runs smoothly and on schedule, clients must arrive fully dressed in their first outfit, ready to begin the photoshoot at the scheduled time. Any delays caused by changing or preparation on-site will reduce the total shooting time, as sessions cannot be extended beyond the allotted time. Please plan accordingly to make the most of your photoshoot experience.
Personal Belongings Clause: Kandi Kam Photography is not responsible for any personal items left behind during or after your photoshoot. While we make an effort to check the area after each session to ensure nothing has been left behind, it is the client’s responsibility to verify that all belongings have been collected. We cannot be held liable for any items that are lost, damaged, or stolen. Please take a moment before leaving to double-check that you have all your personal belongings.
Harassment: The listed client(s) acknowledge their responsibility to ensure appropriate behavior from themselves, event attendees, and/or vendors throughout the service. Should Kandi Kam Photography encounter any inappropriate, threatening, hostile, or offensive behavior directed at the photographer, assistants, or equipment, Kandi Kam Photography reserves the right to immediately terminate the session or event coverage. In such instances, all fees paid by the client(s) will be retained, and Kandi Kam Photography will bear no further responsibility to fulfill services under this agreement.
Harassment and Guest Conduct - Events: The above-listed client(s) are unequivocally responsible for ensuring that all guests, party members, and other vendors exhibit appropriate behavior throughout the event. Should Kandi Kam Photography observe any inappropriate, threatening, hostile, or otherwise offensive behavior directed at their team, assistants, or equipment, they reserve the absolute right to terminate coverage of the event immediately. In such an instance, all fees paid by the client(s) will be forfeited, and Kandi Kam Photography will bear no further responsibilities to the client(s).
Kandi Kam Photography will issue a warning to the client(s) regarding any unacceptable behavior, providing them with the opportunity to rectify the situation or remove the offending individuals from the venue. If the issues are not addressed to Kandi Kam Photography's satisfaction, coverage will cease without any refund, and the client(s) will remain liable for all fees incurred.
Termination of Services: Kandi Kam Photography reserves the absolute right to terminate services at any time, without refund, credit, or transfer of any payments, if the Client or any individual acting on their behalf engages in conduct that violates the terms of this Agreement or otherwise interferes with the safe and professional delivery of services. By booking, the Client acknowledges and agrees to these terms in full.
Grounds for Termination: Grounds for termination include, but are not limited to, the following categories of conduct:
Intellectual Property Violations: Termination will result from any copyright infringement, including violations of the Copyright Law of the United States (U.S.C. 501, Title 17) such as unauthorized reproduction, editing, or distribution of images. Clients may not misrepresent Kandi Kam Photography’s work as that of another photographer, use images to falsely advertise services beyond the agreed scope, attempt to replicate or misappropriate business materials, workflows, or brand identity, or interfere with copyright notices or metadata.
Defamation and Misrepresentation: Termination may occur if a Client engages in business defamation, including publishing or circulating false, misleading, or damaging statements about Kandi Kam Photography. Providing fraudulent booking information, such as false names or contact details, or making misrepresentations regarding image use will also be grounds for termination.
Client Request: A Client may request termination of services in writing at any time; however, all retainers, deposits, and fees paid remain strictly nonrefundable.
Failure to Follow Policies and Deadlines: Termination will occur if a Client fails or refuses to comply with published or contractual business policies, ignores session guidelines such as wardrobe, prop, guest, or location rules, fails to adhere to timelines or deadlines including image selection within two calendar days of proofs, or refuses to acknowledge updated policies when requested.
Disrespectful, Unsafe, or Illegal Conduct: Termination will occur if a Client or their guest engages in any abusive, harassing, threatening, or disrespectful behavior toward the Photographer, staff, vendors, or other clients. Grounds also include intoxication, drug use, threats of bodily harm or harassment, assault, sexual misconduct, or any other illegal conduct. Safety risks such as theft, property damage, or creating unsafe conditions are prohibited. Any violation of health or safety requirements imposed by a venue, local law, or Kandi Kam Photography also constitutes grounds for termination.
Financial Misconduct: Termination may occur if a Client fails to pay required retainers or balances by deadlines, initiates chargebacks or payment disputes without first seeking resolution in good faith, exceeds or ignores agreed payment plans, or fails to provide necessary access, permits, wardrobe, or materials needed to perform services.
Micromanagement or Interference: Excessive micromanagement, including attempts to control creative direction, editing style, or workflow in a way that disrupts the process, is prohibited. This includes demanding real-time image reviews, excessive check-ins designed to pressure expedited delivery, or requests for additional edits or images outside the agreed scope without compensation. Unauthorized third-party interference with the session, editing process, or image delivery also constitutes grounds for termination.
Confidentiality and Privacy Violations: Grounds include the breach of confidentiality, unauthorized disclosure of proprietary materials or behind-the-scenes content, photographing or recording other clients without consent, or sharing confidential information marked as such.
Non-Cooperation and Professional Disruption: Persistent refusal to participate during a session, repeated walk-offs, or ignoring the Photographer’s instructions will be considered non-cooperation. Termination may also occur for misconduct during online communications such as threats or harassment by email, text, or social media, unprofessional conduct toward other vendors or clients, bringing unapproved individuals to a session, exceeding guest limits, or otherwise disrupting professional operations.
Damage, Tampering, and Unauthorized Use: Termination may result from intentional or negligent damage to equipment, props, backdrops, or studio property, tampering with delivered images such as removing watermarks, applying filters, or making edits, or using images for commercial, marketing, or promotional purposes without a written license. Unlawful or unauthorized recording of the Photographer, staff, or other clients during sessions or consultations is also prohibited.
Boundary Violations: Repeated failure to respect professional boundaries, such as excessive personal messaging, communications outside of business hours, or sending non-business content including personal conversations, religious materials, motivational content, or unrelated links, will result in termination. Continued boundary violations after one written warning may lead to immediate termination.
Consequences of Termination: In the event of service termination, the Client forfeits all monies paid toward services and images. All retainers, balances, and additional fees are strictly nonrefundable and nontransferable. Any work completed prior to termination remains the sole property of Kandi Kam Photography and will not be released to the Client. Upon termination, the Client is permanently barred from booking or working with Kandi Kam Photography in the future.
The Client acknowledges that forfeiture of payments is not a penalty but agreed compensation for time reserved, work performed, and opportunities lost.
This policy is governed by the laws of the State of Alabama, and all disputes shall be resolved exclusively in the courts of Madison County, Alabama.
Group and Associated Parties: Client(s) are fully responsible for the behavior and compliance of all individuals who attend, assist with, or are otherwise associated with their session or event. Any violation of this agreement or Kandi Kam Photography’s policies by any such individual will be treated as a violation by the Client(s). If any guest, family member, assistant, or other party acting on behalf of or accompanying the Client(s) engages in conduct that would otherwise constitute grounds for termination, Kandi Kam Photography reserves the right to immediately terminate services. No refunds, credits, or transfers of retainers or fees will be issued under these circumstances.
Permanent Bar for Severe Violations: Any Client(s) whose actions include, but are not limited to, threats, harassment, defamation, abusive behavior, fraud, or any other severe misconduct listed in this agreement, will be permanently barred from booking or receiving services from Kandi Kam Photography in the future. This applies equally to any associated parties whose actions result in termination. This measure is in place to protect the integrity, safety, and reputation of Kandi Kam Photography.
Catch‑All Provision: The above list is not exhaustive. Kandi Kam Photography reserves the right to terminate services for any conduct, behavior, or circumstance that, in the sole judgment of Kandi Kam Photography, compromises safety, violates professional standards, disrupts operations, harms the reputation of the business, or otherwise prevents the successful completion of services as outlined in this agreement. All retainers and payments will remain non‑refundable in such cases.
Defamation, Disparagement & Public Conduct Clause: The Client acknowledges and agrees that while they retain their constitutional right to freedom of speech, this right does not extend to making false, defamatory, misleading, malicious, or disparaging statements about Kandi Kam Photography, its owner, employees, affiliates, contractors, services, or reputation. This restriction applies to all communication, including but not limited to verbal remarks, written publications, social media, online reviews, blogs, forums, or any other medium intended to harm the credibility, reputation, or financial standing of Kandi Kam Photography.
This prohibition includes slander, libel, false or misleading reviews, smear campaigns, and any communication made with intent to harass, intimidate, interfere with operations, or damage the brand. Such conduct constitutes a material breach of this Agreement.
If the Client is dissatisfied, they must provide written notice within seven (7) business days of receiving final deliverables. Kandi Kam Photography will make reasonable efforts to resolve valid concerns in accordance with this Agreement. Public disparagement in place of proper notice and resolution will not be tolerated.
In the event of a breach, the Client agrees to pay liquidated damages of ten thousand dollars ($10,000) per occurrence, in addition to actual damages, punitive damages, attorney’s fees, and court costs. The Client acknowledges these damages are a fair and reasonable estimate of harm, not a penalty.
This clause survives the completion or termination of services. Kandi Kam Photography reserves the right to seek injunctive relief and pursue all remedies to the fullest extent permitted by law.
Micromanagement Clause: The Client grants Kandi Kam Photography full creative control over posing, composition, lighting, editing style, and artistic direction. Micromanagement is strictly prohibited and includes: requesting changes to editing style, demanding real-time reviews, excessive or unsolicited instructions, repeated “check-ins” to pressure expedited delivery, requesting extra images or edits without payment, demanding rush services without purchase of expedited delivery, or attempting to extend sessions without prior agreement.
If Kandi Kam Photography determines micromanagement has occurred, services will be terminated immediately. All payments will be forfeited, and any work completed will remain the sole property of Kandi Kam Photography with nothing released to the Client.
Breaks and Meals Policy - Event Photography: For events over 4 hours, the Photographer is entitled to one 30-minute break. For events 4 hours or longer, the Client must provide a hot meal of the same quality as served to guests, prepared in advance, ready at the scheduled break, and placed in a secure location. This requirement applies to the Photographer and any assistants or second shooters.
The Client is fully responsible for ensuring meals are provided, regardless of arrangements with caterers, staff, or vendors. Break time does not extend contracted coverage hours. Kandi Kam Photography is not responsible for moments missed during the break.
Failure to provide the required meal and break is a material breach of this Agreement and may result in services being suspended or stopped immediately without refund, credit, or transfer.
Confidentiality: Kandi Kam Photography agrees not to use, divulge, disclose, or communicate, directly or indirectly, any proprietary or confidential information belonging to the client(s) for personal benefit. All such information will be treated with the highest level of confidentiality and safeguarded accordingly. This confidentiality agreement remains in effect even after the termination of this contract.
Limitation of Photographer's Role: Kandi Kam Photography and their staff role is exclusively to provide photography services as outlined in this contractual agreement. We are not responsible for managing timelines, coordinating schedules, or performing duties typically associated with a personal assistant, event coordinator, or other roles outside of professional photography. The client(s) acknowledges that the Kandi Kam Photography and their staff’s sole focus will be on capturing images and that no additional services beyond this scope, including but not limited to time management, personal assistance, or emotional support, will be provided. Any requests for such services will not be accommodated, and we shall not be held liable for any related expectations.
Substitution of Photographer Policy: By submitting payment, the Client acknowledges and consents to the following terms regarding substitution of photographers.
Kandi Kam Photography reserves the right, at its sole discretion, to substitute the assigned photographer at any time and for any reason, including illness, personal emergency, scheduling conflicts, or other events beyond the Photographer’s control. The Client will be notified of any substitution as soon as reasonably possible.
Any substitute photographer will be a qualified professional with experience relevant to the services booked. Substitution does not change the agreed scope of services or the quality standards promised. The Client agrees to cooperate fully with the substitute photographer as if originally assigned.
All retainers and payments are strictly nonrefundable. Substitution shall not constitute grounds for refund, credit, or cancellation. The decision of Kandi Kam Photography regarding substitution is final and binding.
Model Release: Kandi Kam Photography reserves the right to use all images and footage from the events listed in this contract for advertising, portfolios, website displays, social media, and other lawful purposes without restriction. By signing this contract, the client(s) waive the right to inspect or approve any images or footage used by Kandi Kam Photography, as well as the right to limit the usage of these images or footage in any way.
Copyrights: All photographs and footage produced by Kandi Kam Photography are protected under United States Copyright Laws and shall remain the sole intellectual property of Kandi Kam Photography. The client(s) waive any claim to ownership, commercial use, or reproduction of these images or footage, except as permitted by a formal written release provided by Kandi Kam Photography. Any usage outside the terms of such a release is strictly prohibited without written consent.
Copyrights for Publications: If the client(s) wish to use any images from their photoshoot for magazines, publications, or any other form of media, they must obtain written consent from Kandi Kam Photography. Failure to receive permission or provide appropriate credit will result in a fee of $1,000 per violation.
Intellectual Property Rights
Image Use by Client (Personal Use License): Upon full payment, Kandi Kam Photography grants the Client a limited, revocable, non-exclusive, non-transferable, worldwide license to use the delivered images (“Images”) for personal use only. This license does not transfer copyright or moral rights. All rights not expressly granted remain the exclusive property of Kandi Kam Photography.

Printing and lab Policy

The Client is not authorized to produce prints through any third-party printer, retail kiosk, online photo service, or home printer.

All physical prints must be ordered directly through Kandi Kam Photography, whose professional print lab ensures accurate color, tone, and archival quality.

Scanning, photographing, or reproducing any proof or print to create new copies is prohibited.
-
Screenshots of proofs or watermarked images to create prints are prohibited.

Kandi Kam Photography specializes in professional printing services, guaranteeing that each image reflects the artistic quality and calibrated color intended during editing. Prints ordered elsewhere are not authorized and will not meet the studio’s professional standards.

Social Media Use

Personal sharing is permitted with proper credit: “Photo by @kandi_kam_photography.”

Heavy filters, AI filters, retouching apps, or edits that alter the style, color, or composition of the image are prohibited.

Watermarks or logos may not be cropped out or covered.

Any boosted posts, paid promotions, advertisements, giveaways, or collaborations using these images require a separate written Commercial License from Kandi Kam Photography.

The client(s) may not:

Use images for any commercial, promotional, or advertising purpose.

Submit images to contests, blogs, or publications without written approval.

Sell, license, or distribute images to third parties.

Create derivative works or heavily edited versions without written consent.

Use images for artificial intelligence training, NFTs, biometric databases, or facial recognition systems.

Remove copyright metadata or watermarks.

Use images in any defamatory, unlawful, or misleading way.

Proofs, RAW Files, and File Integrity

Proofs are for viewing and selection only; they may not be downloaded, shared, posted, or printed.

RAW or unedited files are not provided under any circumstance.

Final delivered files may not be altered, filtered, or retouched beyond minor cropping for display.

Vendor and Third-Party Requests

Vendors (such as event planners, venues, makeup artists, florists, DJs, and publications) must contact Kandi Kam Photography directly to obtain a separate Vendor or Commercial License. The Client does not have authority to grant such permissions to others.

Quality and Color Disclaimer

Kandi Kam Photography guarantees print quality only for orders produced through its professional print lab. Due to calibration differences between screens and consumer printing equipment, unauthorized reproductions may appear distorted in color, exposure, or clarity. Kandi Kam Photography is not liable for quality issues resulting from unauthorized printing.

Termination and Remedies

Any breach of this section automatically suspends and may terminate the license.

Unauthorized third-party printing incurs liquidated damages equal to the greater of two times the studio’s current retail print price or $250 per image per print, plus correction or replacement costs.

Unauthorized commercial use incurs damages equal to three times Kandi Kam Photography’s standard commercial licensing fee per image per use.
-
Unauthorized editing or watermark removal incurs $150 per image.
-
These damages are reasonable pre-estimates of harm and do not limit Kandi Kam Photography’s right to seek injunctive relief, statutory damages, attorney’s fees, or online takedowns.

Duration and Revocation

The license remains valid for permitted personal use, provided the Client remains compliant. Kandi Kam Photography reserves the right to revoke the license for any violation. Upon revocation, the Client must cease all use and delete any stored copies except for one archival backup.

Copyright Notice: All photographs are and shall remain the sole intellectual property of Kandi Kam Photography and are protected under United States Copyright Law, Title 17 of the U.S. Code (§101 et seq.). Kandi Kam Photography. All Rights Reserved. The Client does not acquire ownership of the images. This license does not transfer, assign, or diminish the Photographer’s copyright in any way.
Commercial use is strictly prohibited without prior written consent. Prohibited uses include selling or licensing images, using them for advertising, marketing, promotions, contests, publications, or any other business purpose.
The Client may not alter, edit, or modify images without written consent. Unauthorized changes include cropping, resizing, applying filters or effects, removing watermarks, or making digital edits that distort or alter the original work.
Any violation of this policy constitutes a material breach, results in immediate revocation of the license, and may subject the Client to legal action. The Client agrees to indemnify and hold harmless Kandi Kam Photography against any claims, damages, or liabilities resulting from unauthorized use.
Artistic Style Release: The client(s) is encouraged to review Kandi Kam Photography’s portfolio prior to booking to ensure satisfaction with our artistic style and approach. Client(s) agree that they have spent a satisfactory amount of time reviewing Kandi Kam Photography’s work and has a reasonable expectation that Kandi Kam Photography will perform services in a similar manner and style. Client(s) understand that Kandi Kam Photography will not deviate from their current portfolio style.
Artistic Discretion: The client understands and accepts that Kandi Kam Photography exercises complete creative control over the photographic process, including but not limited to, composition, lighting, editing, and post-production techniques. Kandi Kam Photography’s professional judgment and artistic style, as represented in their portfolio, will guide all aspects of the final images.
Creative Vision: The client acknowledges that Kandi Kam Photography has a unique artistic vision, and while client preferences and requests will be considered, the final images may vary from specific expectations. The client(s) grants the photographer the freedom to interpret scenes, subjects, and moments in a manner that aligns with Kandi Kam Photography’s artistic style.
Artistic Consistency: Kandi Kam Photography will make every reasonable effort to ensure that the services provided are consistent with the artistic style and quality displayed in Kandi Kam Photography’s current portfolio. While the we will strive to meet the client(s) specific requests, the client(s) acknowledges that Kandi Kam Photography retains creative discretion in how the final images are produced and edited, in line with the Photographer’s established style. The client agrees that Kandi Kam Photography artistic vision is integral to the final product and understands that we cannot guarantee exact duplication of any specific image or style from prior work.
Portfolio and Branding: The client(s) consent to Kandi Kam Photography using images from their photoshoot for marketing, portfolio, and branding purposes. The client(s) agree that the images may be displayed on Kandi Kam Photography’s website, social media platforms, and other promotional materials to showcase the photographer’s style and work.
No Revisions: The client(s) acknowledge that once the final images are delivered, they are considered complete, and no further edits or revisions will be made unless agreed upon in advance and specified in the contract. Any requests for re-edits after delivery will be subject to additional charges.
Artistic License: Kandi Kam Photography is granted full artistic license concerning the poses, locations, and overall creative direction of the photoshoot. The client(s) acknowledge that Kandi Kam Photography will not be held responsible for missed or limited coverage due to the following circumstances: client(s) impaired by drugs or alcohol, unavailability for posed photographs, event/session delays, restrictions at desired locations, lack of appropriate props, client(s) unprepared for their session, or failure to provide suitable visuals to the photographer.
Unauthorized Reproduction: The Client(s) expressly agree not to reproduce, modify, alter, or otherwise tamper with any images or footage provided by Kandi Kam Photography without first obtaining a formal written release signed by Kandi Kam Photography. Any violation of this provision shall result in a fine of one thousand dollars ($1,000) per violation. Unauthorized modifications include, but are not limited to, the use of retouching applications to alter appearance (such as changing body size, eye color, or lip color), altering the color balance (including lightening, darkening, or converting to black and white), editing or cropping images, and removing watermarks or proofs from unpaid images. If Kandi Kam Photography identifies any unauthorized reproduction or modification, the Client(s) will be formally notified and required to remove the altered images within twenty-four (24) hours. Failure to comply with this directive will result in immediate enforcement of the stated fine and may subject the Client(s) to further legal action to protect the Photographer’s intellectual property rights.
Intellectual Property Policy: All images, footage, designs, and creative works produced by Kandi Kam Photography (“the Photographer”) are and shall remain the sole intellectual property of Kandi Kam Photography. This includes photographs, videos, graphic designs, and all related content created during the course of services. All works are protected under United States Copyright Law, Title 17 U.S.C. §101 et seq. Kandi Kam Photography retains full rights to use, license, and distribute such works at its discretion.
Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the delivered images for personal, non-commercial purposes only. This license does not convey ownership, copyright, or any right to exploit the works commercially. Clients may not reproduce, sell, license, alter, modify, or edit the works without prior written consent from Kandi Kam Photography. Works may not be used in any defamatory, unlawful, or misleading manner.
The Client agrees to indemnify and hold harmless Kandi Kam Photography from any claims, damages, or expenses, including attorney’s fees, arising from unauthorized use or breach of this policy. Unauthorized use may result in legal action, including damages, injunctive relief, and recovery of attorney’s fees.
Service Inability + Image Loss Policy: In the event Kandi Kam Photography is unable to provide the contracted services, all fees paid by the Client will be refunded, minus any expenses already incurred (such as travel or lodging). Once a refund is issued, Kandi Kam Photography shall have no further liability or obligation to the Client.
Kandi Kam Photography is not responsible for images lost due to uploading, downloading, or transfer errors. While every effort will be made to recover lost images, recovery cannot be guaranteed. If images cannot be retrieved, Kandi Kam Photography may, at its discretion and subject to availability, offer a re-shoot or other accommodation.
If a refund is deemed appropriate, it will be proportionate to the portion of services not delivered. Full refunds will only be issued if the entire session is compromised and no images are recoverable.
Loss of Design: Kandi Kam Photography retains full ownership of all creative designs, layouts, and concepts created during a photoshoot. Final design and delivery of images are at the sole discretion of Kandi Kam Photography.
If digital files, prints, or deliverables are lost, corrupted, or destroyed due to technical issues or circumstances beyond control, liability is limited to the amount paid by the Client for that session. Kandi Kam Photography is not responsible for consequential, incidental, or indirect damages.
Lost or destroyed work will not be replicated or redesigned. A new booking subject to full fees is required. Clients may not alter, recreate, or replicate designs or concepts without written consent. Unauthorized reproduction is subject to penalties under this Agreement.
Clients are responsible for downloading and securing images upon delivery. Kandi Kam Photography does not store images beyond fourteen (14) days. Retrieval after that period may incur fees if files are available.
No refunds, replacements, or reimbursements will be provided except in cases of gross negligence by Kandi Kam Photography, and liability remains limited to the amount paid.
Digital Media Policy: Kandi Kam Photography does not maintain archives of images or footage after delivering the requested images and other goods to the client(s). It is the sole responsibility of the client(s) to request any desired prints, products, or digital files within fourteen (14) calendar days from the delivery of their session/appointment.
Once this 14-day period has passed, Kandi Kam Photography will no longer retain copies of the images or footage, and the client(s) acknowledge that any additional requests for these files will not be fulfilled. No exceptions will be made to this policy, and Kandi Kam Photography is not responsible for storing or maintaining any digital media beyond this timeframe.
Dispute Resolution + Mediation Policy: All disputes or claims arising out of or relating to this Agreement, including but not limited to services, fees, or policies, shall first be addressed through mediation before any other legal action.
The party raising a dispute must provide written notice by certified mail or other verifiable delivery, outlining the nature of the dispute and desired resolution. Within ten (10) business days of notice, the parties shall agree on a mediator. If no agreement is reached, a mediator will be appointed by the American Arbitration Association (AAA) or another designated body. Mediation shall occur within thirty (30) days of mediator selection in Huntsville, Alabama, unless both parties agree otherwise. Each party shall bear its own costs; mediator fees will be shared equally unless agreed otherwise in writing.
If mediation does not resolve the dispute within sixty (60) days, the matter shall be submitted to binding arbitration under AAA rules. Arbitration will be conducted by a single arbitrator, whose decision will be final and binding. Both parties waive their right to bring claims in court, including jury trial.
All mediation and arbitration proceedings shall be confidential. No information obtained may be disclosed except as required by law or for judicial enforcement of the arbitration award. If any provision of this policy is found invalid, the remaining provisions remain enforceable.
Liability Waiver Clause: The Client acknowledges that photography sessions involve certain risks, including personal injury, property damage, and weather-related conditions. The Client voluntarily assumes all risks, including those arising from the actions or negligence of Kandi Kam Photography, its owners, employees, agents, or representatives (“Released Parties”).
The Client releases and discharges the Released Parties from all claims, liabilities, damages, costs, or expenses (including attorney’s fees) related to the session, including claims for personal injury, property damage, or other loss by the Client or any third party.
The Client agrees to indemnify and hold harmless the Released Parties against any claims or expenses arising from the actions, negligence, or omissions of the Client, their guests, or third parties during the session.
The Client is responsible for ensuring chosen locations are safe and suitable. Kandi Kam Photography is not liable for injuries or damages caused by unsafe conditions, terrain, lighting, or weather. The Client is also responsible for any damage to Kandi Kam Photography’s equipment caused by the Client or their guests and agrees to pay for repair or replacement.
The Client affirms they are at least eighteen (18) years of age or have obtained parental or guardian consent. If any part of this Waiver is found invalid, the remaining provisions remain enforceable.
Indemnification Policy: The Client agrees to indemnify, defend, and hold harmless Kandi Kam Photography, its owners, employees, agents, affiliates, contractors, and assigns from any and all claims, damages, liabilities, losses, or expenses, including attorney’s fees, arising out of or related to the services provided.
This obligation includes claims resulting from the actions, negligence, or omissions of the Client, their guests, vendors, or third parties under their control. It also covers any third-party claims related to the Client’s use of images, footage, or services, including intellectual property infringement, defamation, invasion of privacy, or violations of law.
The Client further accepts responsibility for any damage to Kandi Kam Photography’s equipment, property, or personnel caused by the Client, their guests, or associated parties. This indemnification also applies to unauthorized reproduction, modification, or distribution of images or footage, as well as any accidents, injuries, or property damage occurring during a session or event where services are provided.
This indemnification provision shall survive the expiration, completion, or termination of services and remain fully enforceable thereafter.
Weather and Environmental Conditions Clause: Kandi Kam Photography reserves the right to postpone or cancel a session due to adverse weather or unsafe conditions. In such cases, clients will be notified promptly, and a mutually agreeable reschedule date will be arranged. If the client chooses to proceed with the session despite adverse conditions, Kandi Kam Photography will not be held liable for the quality or outcome of the images.
Force Majeure: Neither party shall be liable for delay, default, or nonperformance caused by circumstances beyond its reasonable control, including but not limited to acts of God (hurricanes, earthquakes, floods), fires, government restrictions, wars, terrorist acts, insurrections, or other events outside the affected party’s control.
If a session is canceled, postponed, or impacted by a force majeure event, all payments made to Kandi Kam Photography are non-refundable. The Photographer will make reasonable efforts to reschedule, subject to availability.
In such cases, a studio credit equal to the total amount paid will be issued and must be used within thirty (30) calendar days. Unused credits will expire, and the Client forfeits the right to apply them.
Acknowledgment of Terms and Conditions: The Client acknowledges and agrees that the submission of any payment to Kandi Kam Photography, including but not limited to retainers, deposits, or balances, constitutes the Client’s full acknowledgment, acceptance, and binding agreement to all terms, conditions, and policies contained within this Contract. Payment serves as the Client’s legal signature and carries the same force and effect as a handwritten or electronic signature.
The Client further understands and agrees that services will not be reserved, scheduled, or rendered until the required payment has been received. By remitting payment, the Client expressly affirms that they have read, understood, and consented to be bound by all provisions of this Contract. The Client also waives any defense or claim that they did not review, receive, or understand the terms prior to making payment.
All payments made are deemed conclusive proof of contractual acceptance and are subject to enforcement under applicable contract and consumer protection laws. Nonpayment shall be deemed a refusal to enter into this Agreement, and no obligations shall be imposed on Kandi Kam Photography unless and until payment is received.
